TERMS & CONDITIONS
The following terms and conditions apply to all transactions with JM Customs Ltd. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a
copy for future reference.
These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
ACCEPTANCE OF ORDERS
It is an implied term in all quotations and all order acknowledgements, that all necessary specifications, instructions and information shall have been supplied by the Purchaser. Delivery dates and prices may be adjusted by us to allow for any delay in the supply of specifications, instructions or information required from the Purchaser. If incorrect or insufficient information is given with any order, JM Customs Ltd will not be liable for a refund or replacement.
The Purchaser will ensure that the goods as ordered are fit for the purpose required. The goods are supplied without any guarantee or warranty save that they are in accordance with the specification or description shown as may be applicable. The parts we supply should be installed by a professional and qualified mechanic.
JM Customs Ltd reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer.
AVAILABILITY OF GOODS
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason, we will not charge you for these and we will refund any money owed. However, we will not be responsible for compensating you for any other losses you
may suffer if we do not supply the goods.
PRICE & PAYMENT METHODS
We accept all major credit and debit cards via the PayPal secure payment system. On the order you must provide us with your exact shipping address and telephone number. If you have provided an unconfirmed PayPal payment there may be a delay of 5 working days before the items are dispatched to ensure payment has cleared. If you wish to pay by another method
please contact us directly.
Unless otherwise stated in the order acknowledgement, the price charged shall be the price ruling at the date of dispatch for each item supplied, and if the goods, or any other part of the goods are purchased by JM Customs Ltd at a price higher than the price ruling at the date of
order acknowledgement, we may adjust the price accordingly. Prices quoted in a different currency may be increased to compensate for exchange losses to JM Customs Ltd. We will inform you of the correct price and give you the opportunity to cancel the order. Unless otherwise
stated prices are quoted ex works.
If a deposit is made for an ordered part, we reserve the right to retain that deposit in the event of the order being cancelled. Parts will be dispatched to the customer when full payment has been received.
Shipping charges are dependent on the volumetric weight or actual weight (whichever is the highest) of the product purchased and the destination. We will try to find the most reasonable carrier and rate for your country and will provide you with a quote prior to order placement. It may not be possible to accurately calculate the shipping costs for oversized or heavy items until the order is being prepared.
We will notify you if there is an increase in the shipping charge on your order prior to invoice and shipping.
Deliveries will usually be made on Mondays to Fridays between 9am and 6pm. If couriers have attempted delivery on more than one occasion and retained the goods for collection, they will eventually return undelivered goods to the sender. You are responsible for any additional
charges (Inc. any related duties and taxes) to re-ship or forward your package if the package is undeliverable due to an incorrect shipping address or if the purchaser was not available to receive goods or refused delivery.
International orders may incur duties and taxes at the discretion of the country you are shipping to. The Recipient is responsible for all applicable duties and taxes associated with your order. The Purchaser must inform the Company of any missing, incorrect or defective goods
immediately upon receipt. Couriers have strict time limits on reporting of missing/damaged items. If reporting is outside of these times they will normally reject any claim for compensation.
We hope you will be highly satisfied with any product purchased from us but if you wish to return an item to us you must contact us by phone or email and receive an RA (Return Authorisation) number before returning your item. Items returned to us without prior agreement will not be
eligible for a refund. The customer is responsible for return shipping and handling costs and it is the customers responsibility to ensure goods being returned arrive back to us in a good condition. Please return goods, where possible, in original packaging and via an insured, traceable method for your protection. We are not responsible for packages lost/damaged during return shipping. All returns must be made within 14days of receipt and a refund will be issued if, upon inspection, we find the merchandise to be in good and unused condition. Original shipping
and handling charges are not refundable and these amounts will be deducted from the original amount invoiced and the remaining balance will be credited to the original credit card or relevant payment method. All special and bespoke items are non-returnable.
There are absolutely no refunds on used, damaged by the customer or altered goods. Any returns sent C.O.D. will not be accepted. When returning items from outside the EEC please ensure an invoice is included from you with an explanation for the return and a statement that the
goods originated from us. If this is not enclosed Customs will insist on payment of duty before goods are released to us. In this instance we reserve the right to refuse delivery and they will be returned to you at your expense. Please include your name and address with any goods
JM Customs Ltd shall have no obligation in the event a part is modified by any other person or organisation, or if a part becomes defective as a result of improper installation, improper maintenance, improper use, abnormal operation, or any other misuse or mistreatment. JM
Customs Ltd shall not be liable for any consequential or incidental damages resulting from the failure of a part, the breach of any warranties, the failure to deliver, the delay in delivery, delivery in non-conforming condition, or any other breach of contract or duty between JM Customs Ltd and a customer.
1. Any goods which are subject to a warranty claim should be returned to us for inspection. Upon
inspection we will repair or replace defective part.
2. Warranty does not cover accidental or deliberate damage, acts of god, damage incurred by
incorrect use or installation or not following manufacturer’s instructions. The goods must not be
modified or repaired.
3. Any products that have not failed due to manufacturing defect will be repaired at the cost of
the customer. We reserve judgment on this and our decision is final.
4. Carriage and handling costs for the return of goods to us will be the responsibility of the
customer. Non warranty repairs are carriage chargeable.
5. Warranty does not cover the incorrect purchase of our products, if goods are returned due to
incorrect specification then we reserve the right to refuse the return of goods or charge a return
to stock fee.
CUSTOM BIKE BUILDS
All parts supplied or fitted by JM Customs Ltd are intended for Customising purposes. It is your responsibility as the customer to ensure that your vehicle is fit for use on a public road. JM Customs Ltd will not be held liable for any loss or personal injury, immediate or consequential
arising from the fitment of JM Customs Ltd modifications. The installation of some parts may also void or adversely affect your factory warranty or insurance conditions and it is your responsibility to check these with the relevant country.
All quotations are for costing purposes only and prices may be subject to change if supplier prices change or a part becomes unavailable. If this occurs, we will endeavour to source an alternative part for a similar price/quality however, where this is not possible, JM Customs Ltd
cannot be held liable for any price changes. In these circumstances you will be notified of any issues and given the option to modify the order or omit the part. It is an implied term in all quotations and all order acknowledgements, that all necessary specifications, instructions and
information shall have been supplied by the Customer. Delivery dates and prices may be adjusted by us to allow for any delay in the supply of specifications, instructions or information required from the Customer. If incorrect or insufficient information is given with any order, JM
Customs Ltd will not be liable for a refund or replacement.
Payment terms – We require a 50% deposit at commencement, one interim payment of 25% through the build and a final payment of the balance due prior to completion/hand over. Slot Securement: To book a Custom Build space in our Diary we require a fee of £500 .
Where a deposit is made for an ordered part or bike build, we reserve the right to retain that deposit in the event of the order being cancelled. Many parts are made to order and cannot be cancelled once manufacturing has begun. The Purchaser will be liable for all costs incurred by JM Customs Ltd in connection with the cancelled contract.
All parts supplied by JM Customs Ltd are the property of the JM Customs Ltd until full payment has been received, and any order cancellations or modifications may be subject to a 20% charge to cover any handling fees or expenses incurred.
Delivery Dates – We will provide an estimated completion date with your order; however, this cannot be guaranteed and may be subject to change depending on external suppliers/painters etc. We cannot be held responsible for external manufacturer’s unforeseen problems and delays due to holidays etc.
Insurance for the motorbike is the owner’s responsibility for the entire duration of the project. This includes any time spent at JM Customs Ltd workshop, at other suppliers’ premises or during transit at any point throughout the project so you should notify your insurers accordingly. By choosing the customisation route, you are seeking to create a unique motorcycle which stands apart from an off the shelf model. During this process JM Customs Ltd may fabricate or modify a vast range of fittings and interfaces. The very nature of customisation means that it is not always possible to get a perfect setup first time and the bespoke manufacture of any part may be subject to several alterations/amendments before a satisfactory fit is achieved. If your bike needs to come back to the workshop for any alterations/amendments this is at your expense.
JM Customs Ltd warrants to the original owner that any work undertaken by JM Customs Ltd or any product supplied by JM Customs Ltd , if properly installed, maintained, and operated under normal good conditions shall be free from any defects in material and workmanship, for a period of 12 months from the date the goods are sold to the customer. The warranty is applicable only to work undertaken directly by JM Customs Ltd . In the event of repairs or partial modifications to an existing bike, any subsequent issues arising on parts unrelated to the work undertaken by JM Customs Ltd are not covered.
JM Customs Ltd shall be released from any obligations under this warranty in the event repairs or modifications are made by any other person or organisation or if the warranty claim results from abuse, misuse, or normal wear and tear of the product. No agent, employee or representative of JM Customs Ltd may bind any affirmation or modification of this warranty concerning the goods sold under this contract. The obligation of JM Customs Ltd, and the customers sole and exclusive remedy, shall be limited to replacement or repair of any goods
which are returned to JM Customs Ltd , transportation, shipping and postal charges prepaid. In the event the JM Customs Ltd goods are discontinued or obsolete, the customer shall be entitled to a refund of the purchase price.
JM Customs Ltd shall not be liable for any consequential damage or incidental damages arising from the breach of any warranties, the failure to deliver, delay in delivery, delivery in non-conforming conditions, or for any other breach of contract or duty between JM Customs Ltd and
JM Customs Ltd shall not be liable for any delay arising from circumstances beyond its control or which make it impractical for it to complete the order in time or at all. In particular, we shall not be liable for the consequences of war, civil disturbance, and acts of government, acts of God, industrial disputes or shortages of supplies or labour.
